Contract Conditions

This agreement governs the General Purchasing Conditions of the different services offered on this webpage by FINCAS FORCADELL SLU holder of NIF No. B60027182 and registered address at PL. UNIVERSITAT 3, BAIXOS, 08007, Barcelona (Spain). 

Upon completing the registration process and purchase of any of our services, expressly accepts and submits to the specific clauses below and to the conditions on accessing and using our portal and its privacy policy, available via the link Legal Notice.

The CLIENT acknowledges sufficient legal capacity to be contractually bound.

This contract is permanently available in the legal notices on our webpage and can be downloaded in PDF format at the time of contracting.

1. Prices and Taxes

In consideration for the service acquired, the CLIENT expressly accepts to pay to FINCAS FORCADELL SLU the sums specified at the time of purchase on the price list shown on the website  www.placidament.com for the chosen services.

The services offered on this website are subject to Value Added Tax (VAT) that IS INCLUDED in the prices detailed for each service. 

Once the services have been selected and following confirmation of the order and prior to making payment, the final purchase price will appear on the screen, which includes the VAT (Value Added Tax), handling, which will be shown on the purchase order at the time of purchase and on the bill.

It does not include any time not specified in the description as included.

2. Purchase Procedure

Orders may only be placed on this webpage by natural persons aged over 14 and companies.

The webpage sets out all our services individually. The procedure for making and handling the purchase is shown on the webpage and the following steps must be applied: 

a. Choose the service you wish to reserve.
b. When selecting a service, it can be added to the Shopping Cart and the client can continue to shop or process the reservation.
c. To process the order, you will have to fill in a form with your personal data to formalize the reservation procedure.
d. The order showing the articles selected one by one will then be checked and the total price calculated.
e. It is also necessary to indicate the billing and delivery addresses for the purchase.
f. Once this process is complete, it is necessary to check the box indicating that the terms and conditions of sale have been read and accepted.
g. The systems available for making payment in accordance with the method chosen in each case appear on the webpage.
h. Once the payment details have been entered, the client must confirm the order by pressing on the “Reserve” button.
i. Once the button “Reserve” has been clicked, the order confirmation will be sent by e-mail.

The CLIENT is aware that the photographs and descriptions of the services on the webpage are an approximate image of the services offered and that they may differ from the original. The descriptions and illustrations of the services offered on this webpage are solely for information purposes.

3. Availability and Delivery

The services offered by FINCAS FORCADELL SLU are available only in Spain. 

The orders will be processed once the payment has been received correctly. 

In order to be informed at all times of the management of your purchase, you will receive by email a notice of the confirmation of your reservation. 

4. Payment and Payment Periods

The following forms of payment are accepted: 

  • Credit Card: The transaction is made by connecting directly with the bank CAIXABANK through its payment gateway.
  • Bank transfer: making a deposit of the total amount of the purchase in the current account indicated.

Once payment is made you will receive a confirmation email.

FINCAS FORCADELL SLU does not have any knowledge of the details of your credit card. Our payment systems are fully secure.

Payment are prior to delivery of the provision of the service and therefore FINCAS FORCADELL SLU will not supply the service ordered until such time as it has received payment of same. 

FINCAS FORCADELL SLU reserves the right to temporarily or definitively cancel any orders placed due to any incident affecting collection of same.

5. Bills

You can request an invoice for your reservation by writing to the e-mail address below: hola@placidament.com.

The CLIENT is responsible for confirming reception of any notifications and informing us of any modification to their details, and FINCAS FORCADELL SLU shall not accept any liability arising from this circumstance.

6. Warranty

In FINCAS FORCADELL SLU we strive to provide services of the highest quality, although, given the nature of them, we can not offer a guarantee of satisfaction. In the event that, for any reason, you do not receive the service correctly, you should inform us as soon as possible indicating the incidence and we will try, if the error is verified, to correct it as soon as possible.

7. Returns

Given the nature of the service covered by this contract, it is not possible to make refunds. 

8. Right of Withdrawal

In accordance with the provisions of the Royal Legislative Decree 1/2007, of November 16, 2007, on the Defense of Consumers and Users in Article 103 point l), we inform you that the right of withdrawal shall not apply to the provision of accommodation services for purposes other than serving as housing or services related to leisure activities, if the contracts provide for a specific date or period of performance.

9. Perfección of the contract and modification of services

This contract is perfected by payment of the service and shipping to the CLIENT with a confirmation email containing a description of the purchase.

FINCAS FORCADELL SLU reserves the right to modify in any manner any of the characteristics and conditions of its services with a view to enhancing same and benefitting the CLIENT.

10. Obligations of the Parties

FINCAS FORCADELL SLU undertakes to supply the CLIENT with the services acquired, using due diligence in providing the service and safeguarding the necessary facilities for operation of the network, for which purpose it has adequate technical and IT equipment.

The CLIENT undertakes to use the services at their disposal in good faith without infringing any laws or third-party rights and to pay for the service selected in the manner and at the time set forth in these sales conditions.

FINCAS FORCADELL SLU does not warrant that the availability of the service referred to herein is continuous or uninterrupted due to circumstances originating as a result of Internet issues, breakdown of IT devices or other unforeseeable circumstances. The CLIENT therefore accepts to tolerate these circumstances within reasonable limits and expressly waives any claim against FINCAS FORCADELL SLU for any contractual or extra-contractual liability for any failures, errors or use of the service engaged.

11. Communications

All and any notices between the parties shall be preferably via email. The CLIENT is responsible for confirming reception of any notices and informing FINCAS FORCADELL SLU of any modification to their details, and the latter shall not bear any liability arising from this circumstance. In the event of a modification, the CLIENT must inform FINCAS FORCADELL SLU by email or by calling the telephone numbers appearing on our webpage.

Pursuant to article 21 of Law 34/2002 on Information Society and Ecommerce Services we inform you that are commercial communications and information relating to our website and the services offered there will be carried out by email to the address provided, which will be revocable. You have in any event the option of rejecting our commercial communications by sending an email to hola@placidament.com with the subject line UNSUBSCRIBE.

12. Commitment, Acceptance and Validity of the Contract

The CLIENT acknowledges having read and accepted the legal conditions of use and privacy policy of the webpage.

The CLIENT acknowledges they have understood all the information regarding the services including, if applicable, those of delivery as presented on our webpage together with all the conditions and stipulations contained herein and attests that they are sufficient to exclude any error in consenting hereto and therefore expressly accepts same in full.

The CLIENT is fully aware that the acceptance and execution of this contract shall take place by providing their data and by pressing the “Reserve” button on our webpage and perfected by payment of the service.

13. Applicable Legislation

This contract shall be governed and construed pursuant to Spanish law.

Should any type of discrepancy or dispute arise between the parties as to the construction, content or execution hereof which is not resolved by mutual agreement, the Parties shall submit to the courts or tribunals that are competent in each case.

14. Security of Your Personal Data

The contracting process requires you to fill in personal data forms in order to process and manage orders and, if authorized, to send you commercial information about our services. The provision of such personal data requires prior approval of our Privacy Policy.

NB: These General Purchasing Conditions were modified on 18/04/2024. We may modify them at any time and alter the prices and services offered. Please check the date of issue every time you connect to our Webpage so as to ensure no modification has been made that may affect you.
